REFUND POLICY

This policy is part of the Terms of Service. It is written under United States federal consumer-protection law and, where Russian law applies, the Civil Code of the Russian Federation (ГК РФ). Mandatory rules that cannot be waived remain in force.

UNITED STATES

United States federal law does not give a general right to cancel an online purchase of digital course access because you changed your mind. The FTC Cooling-Off Rule (16 C.F.R. Part 429) does not cover sales made entirely online, by mail, or by telephone.

The Federal Trade Commission Act, 15 U.S.C. §§ 41–58, prohibits unfair or deceptive acts. A “no refunds” statement cannot be used to keep a payment if FRAME does not provide the access that was sold. Credit-card billing-error rights, including for goods or services not delivered as agreed, are in the Fair Credit Billing Act, 15 U.S.C. § 1666, and are exercised with the card issuer.

CIVIL CODE OF THE RUSSIAN FEDERATION

This page, together with the public offer, contains the essential terms of the contract (ГК РФ arts. 432, 435, 437). Payment for FRAME is acceptance (ГК РФ art. 438(3)). Obligations must be performed (art. 309). Unilateral refusal is allowed only where the Code, another statute, or the contract permits it (art. 310).

FRAME is a mixed contract (art. 421(3)): a license to use copyrighted course materials (arts. 1235, 1286) and access to those materials on the site. After access is activated, the license is granted and the digital materials are made available; they cannot be returned in kind.

If the contract is treated as paid services (ch. 39, arts. 779–783), art. 782(1) allows the customer to refuse performance by paying the provider’s actual expenses. Once access is activated, those expenses are the cost of granting the license and providing the materials — typically the price paid. Art. 782 is not a right to a full refund after delivery of digital access.

If we take payment and do not provide access, or we receive a second payment without a second grant of access, that sum is unjust enrichment and must be returned (arts. 1102, 1103). For a consumer residing in the Russian Federation, art. 1212 preserves mandatory protections of Russian law that cannot be waived by choosing another law.

NO REFUND FOR CHANGE OF MIND

After LavaTop confirms payment and FRAME access is activated, the sale is complete. We do not refund for change of mind, unused materials, or dissatisfaction with training results. This is disclosed before checkout on the purchase page.

WHEN WE DO REFUND

We refund the amount paid, through the original method where practicable, if:

1. Payment was confirmed and course access was not activated as described in the Terms.

2. You were charged twice for the same purchase without a second grant of access.

3. A refund is required by a statute or a final order that applies and cannot be varied by this policy — including mandatory rules of the ГК РФ cited above.

PRICE AND BILLING

FRAME is $69 USD, billed once. There is no automatic renewal. Payment is processed by LavaTop. Coaching on Instagram is not sold on this website and is not covered here.

PAYMENT REVERSALS

If a confirmed payment is reversed (including a chargeback), we may suspend or revoke the related access (ГК РФ arts. 328, 401 as to counter-performance). A reversal is not a FRAME refund under this policy.
